Annexation Bill Moving; Contact Your Senator Now!

SB 289, a bill that would place new restrictions in annexation law and is opposed by the League, faced a new hearing in the Senate State and Local Government and Veterans' Affairs Committee this past week and is expected to be voted out of that committee and to the floor of the Senate this coming week.

At the hearing the Ohio Township Association and the Ohio Homebuilders Association testified in favor of a new amendment to the bill that would amend the special procedure for a 100% owner petition annexation. That amendment is the product of a negotiation among township and private sector interests (homebuilders, developers and Realtors). The committee adopted that amendment.

Despite the agreement on that amendment which leaves many of those private sector groups in a position of not opposing SB 289, the League's concerns about the bill remain. SB 289 still contains provisions that would consider areas within 1/2 mile of any annexation pertinent to that annexation and require municipalities which withdraw annexed territory from a township to pay that township overly-generous reparations for that annexation. These provisions are still not acceptable to the League.

Because of those provisions, we would ask you to continue to talk to your members of the General Assembly about our objections to the bill in its current form. This issue is now alive in both houses so it's important that you talk to both your House and Senate members about this bill.

 

It is expected that the Senate Committee will take up SB 289 when it meets at a special time (Tuesday, 9:00 a.m., Senate Finance Hearing Room) and vote the bill out for consideration by the full Senate at that body's Wednesday Floor Session. The House Local Government Committee will hear testimony on SB 289's companion bill (HB 98) at 2:30 p.m. on Wednesday in Room 121 in anticipation of dealing with SB 289 after the November elections.
