PLEASE CIRCULATE THIS BULLETIN TO YOUR COUNCIL, DEPARTMENT HEADS & STAFF Bulletin No. 17 November 9, 2000 Annexation Bill Heard. A first hearing in the House was given to SB 289, the annexation bill passed by the Senate, in the House Local government and Townships Committee. The only witness for this hearing was Senator Robert Cupp, who was the sponsor of the bill in the Senate. Though Senator Cupp said that "most of the controversy" surrounding the bill had been worked out in the Senate, the League continues to oppose the bill in its current form and is continuing to work for amendments that would improve the legislation. Contractor Bill to be Heard. It is expected that the Senate Insurance, Commerce and Labor Committee will hear HB 434 next week. This bill provides for a state license of many commercial and industrial contractors, while still allowing for municipal governments to require a number of assurances to the public at the local level about the work performed by those contractors, including bonds and registrations. The League has been involved in negotiations on this bill and is satisfied with the bill as redrafted. There is still some concern that further amendments to the bill in committee may change our position, but we think the bill will be acceptable in the end. If you have any concerns about this bill or questions about the legislation, please, let us know prior to the bill's hearing next week. Municipal Income Tax Amendment May Be Proposed for SB 287. SB 287 is a bill that would provide natural gas companies with tax treatment that mirrors the tax treatment given to electric companies under state deregulation. However, there will also be an amendment offered to the bill that would try to clarify some of the changes made earlier this year to municipal income tax law related to S-corporations. We think this will not be a major amendment, but we are still waiting to see final copy on the amendment. Once we have that copy, we will distribute the amendment to a number of municipal tax officials for their advice. SB 287 is being considered in the House Ways and Means Committee. HB 796 Limited in Its Focus. HB 796, which was introduced in the House this past week, deals with the subjects of annexation and mergers. However, it should be noted that this bill is not meant to be a bill that addresses these issues on a broad basis, but attempts to deal with issues unique to a situation in Montgomery County. The bill has been referred to the House Local Government and Townships Committee. As of deadline, we have not received a full slate of committee hearings. The following list is an estimate as to what will be heard next week. (2nd Hearing - Sponsor, proponent, opponent - Amendments - Possible vote) HB 298 SMOKING RULES (Schuler) Requires that any orders or rules enacted by a board of health related to smoking be adopted by the legislative authority of a municipal corporation or township before those orders or rules are effective within the boundaries of that political subdivision.
