ANNEXATION

May 31, 2001

SB 5 was voted out of Committee, sent to the House floor and approved by the full House last evening.

Tuesday, May 29, late in the day a substitute version of SB 5 surfaced and became available to interested parties.

Wednesday, May 30 the House Local Government and Townships Committee met in the morning and did not vote out SB 5. Early Wednesday evening after a series of meetings and party caucuses the committee quickly reconvened and voted out the substitute version of SB 5. The bill proceeded to the floor in the next few hours where it received approval.

The substitute bill contains some helpful amendments thanks to Speaker Householder, Representative Larry Wolpert and Representative Amy Salerno. However, the major concerns of municipalities i.e. 1) the ½ mile area outside the annexed territory issue was not addressed and 2) the overly generous reimbursement schedule was insignificantly reduced.

All of the private sector interests who had significant problems with basically the same bill last session, did not have any problems with SB 5 as it went to the floor. In fact most were proponents.

The next step is concurrence by the Senate which is expected to occur early next week.

It is imperative that you contact your Senator urging a "NO" vote.
It is not too early to contact the Governor urging him to veto the bill.
