LEGISLATION OF INTEREST INTRODUCED IN THE 122ND GENERAL ASSEMBLY BILL STATUS AS OF 7/13/98 SENATE BILLS SB 1 DOMESTIC VIOLENCE (KEARNS) Am & En. 737, 1901, 1907, 2919, 2935, 2937, 3113. Relative to the issuance and enforcement of temporary protection orders issued in domestic violence situations, protection orders and consent agreements issued or approved by a court of domestic relations, and protection orders of those types issued by courts of another state. The bill became effective October 21, 1997. SB 5 EMERGENCY SERVICES (HOWARD) En. 4742. Establishes training and continuing education requirements for emergency service telecommunicators, requires the state board of education to develop and administer a training program for emergency service telecommunicators, allows public agency telecommunicators to be trained in the program at no tuition or materials charge to the agency or teleconunumicator, and makes an appropriation. The bill became effective November 5, 1997. SB 10 PUBLIC SAFETY VEHICLES (GAETH) Am 4511. Defines the vehicles of emergency management agency personnel as "public safety vehicles," in certain circumstances. The bill has been assigned to the Senate Highways & Transportation Committee. SB 11 RADIOACTIVE WASTE (SUHADOLNIK) Amends & En. 3747. Clarifies that the Board of Directors of the Ohio Low Level Radioactive Waste Facility Development Authority may select more than one contractor to execute the duties assigned to a contractor for the development and operation of such a facility and makes other changes in the statutes governing the Board. The bill became effective 8/6/97. SB 15 RESIDENCY REQUIREMENT (SUHADOLNIK) En. 3. Prohibits a political subdivision from requiring its employees to reside in any specific area of this state. The bill was DEFEATED on the Senate floor. SB 27 WORKERS' COMPENSATION (HORN) Amend Sec. 4123. Permits public employers to become self-insuring for purposes of the Workers Compensation Law, permits certain organizations with a membership consisting of public employers to qualify for self-insuring status, requires the administrator of Workers Compensation to adopt rules regarding claims administrators, decreases the number of votes necessary for the Self-Insuring Employers Evaluation Board to revoke an employees self-insuring status and requires the administrator to provide for payment of claims of a defaulting self-insuring employer within 30 days after the default. The bill has been assigned to the Senate Insurance, Commerce & Labor Committee. SB 57 INCOME TAX DEDUCTION/FIRE FIGHTERS(DIDONATO) Amends section 5747.01 of the Revised Code to create a state income tax deduction of up to $750 for amounts paid by a fire fighter or auxiliary police officer for training programs, clothing and equipment used primarily for fire fighting or law enforcement purposes. The bill has been assigned to the Senate Ways & Means Committee. SB 65 WORKPLACE SAFETY COMMITTEE/ WORKERS' COMPENSATION DISCOUNT (HERINGTON) Amends section 4123.34 of the Revised Code to permit the Administrator of Workers' Compensation to give discount on premium rates for employers that establish an employee-management safety committee and implement official recommendations of that safety committee. The bill has been assigned to the Senate Insurance, Commerce & Labor Committee. SB 71 CONSTRUCTION CONTRACTS (CUPP) Amends sections 153.56 and 2305.31 and to enact section 4113.62 of the Revised Code to void various types of provisions of a construction contract or subcontract that are considered to be against public policy, to prohibit construction contracts from requiring the purchasing of specific liability insurance, to establish new requirements and limitations relative to exercising rights under bond for certain public improvements. The bill has been signed by the Governor and is effective September 30, 1998. SB 73 SANITARY DISTRICTS (HAGAN) Amends sections 121.22, 145.012, 6115.10, 6115.20, and 6115.65 and to enact sections 6115.103 and 6115.104 of the Revised Code to alter the composition and method of appointment of the members of the boards of directors of certain existing sanitary districts organized to provide a water supply for domestic, municipal and public use, and to limit the compensation paid and benefits provided to board members. The bill has been assigned to Senate Health Committee. SB 77 FINANCIAL REPORTS (GILLMOR) To amend sections 117.10 and 117.38 of the Revised Code to require certain public offices to publish a notice announcing the completion and availability of their annual financial reports instead of publishing the reports themselves, to make other changes regarding these reports, to require notification of the Auditor of State upon the creation or dissolution of a public office, and to allow the Auditor of State to audit the accounts of individuals receiving public money. The bill has been signed by the Governor. SB 83 LAND USE VIOLATIONS (JOHNSON) To enact sections 765.01 to 765.08 of the Revised Code to authorize municipal corporations to establish noncriminal land use infractions, to provide civil enforcement procedures for any such land use infractions established, and to authorize the establishment of land use violations bureaus to deal with such infractions. The bill has passed the Senate and been referred to the House Urban Subcommittee. SB 94 PROPERTY TAKINGS (CUPP) Fosters the protection of private property by requiring governmental agencies to utilize summaries of case law prepared by the Attorney General in considering certain governmental actions that may result in a taking of property requiring compensation under the Ohio Constitution and the U.S. Constitution and requiring the preparation of written assessments of such government actions. The bill has been assigned to the Senate State & Local Government & Veterans Affairs Committee. SB 116 ELECTIONS LAW (GARDNER) To amend sections 3599.02, 3599.11, 3599.12, 12 3599.14, 3599.17, 3599.18, 3599.19, 3599.20, 13 2599.21, 3599.22, 3599.23, 3599.25, 3599.31, 3599.32, 3599.35, 3599.36, 3599.37, 3599.38, 3599.39, and 3599.40 and to repeal section 3599.30 of the Revised Code to change certain penalties in the Elections Law and to make other changes in that Law. SB 141 LOCAL LIQUOR OPTIONS (SCHAFRATH) To amend sections 4301.01, 4301.34, 4301.37, 4301.39, and 4305.14 and to enact sections 4301.322, 4301.332, 4301.353, 4301.354, 4301.363, and 4301.364 of the Revised Code to allow a local option liquor election on the sale of beer, the sale of wine and mixed beverages, the sale of spirituous liquor, and Sunday sales in a portion of a precinct or residence district where the status of such sales as allowed or prohibited is inconsistent with the status of such sales in the remainder of the precinct or residence district to shorten from four years to one year the period before certain local option liquor questions maybe resubmitted to the voters, and to declare an emergency. JOHNSON) To amend sections 303.21, 305.31, 319.202, 319.302, 319.54, 321.261, 321.45, 322.01, 322.02, 322.021, 322.03, 322.05, 322.99, 323.151, 323.152, 323.153, 323.154, 323.155, 323.156, 323.31, 325.31, 519.21, 1151.349, 1345.71, 1506.01, 1521.01, 1923.01, 3733.01, 3733.02, 3733.021, 3733.022, 3733.025, 3733.06, 3733.101, 3733.11, 3733.19, 3781.06, 3781.07, 3781.10, 3781.181, 3791.04, 4501.01, 4503.04, 4503.042, 4503.06, 4503.061, 4503.062, 4503.063, 4503.064, 4503.065, 4503.99, 4505.01, 4505.06, 4505.08, 4505.11, 4505.20, 4511.701, 4517.01, 4517.03, 4517.30, 4703.18, 4733.18, 4905.90, 5117.01, 5701.02, 5728.01, 5739.01, and 5739.02 and to enact sections 303.212, 322.06, 519.212, and 3781.184 of the Revised Code to define "mobile home," "manufactured home," "industrialized unit," and "recreational vehicle" to create distinct classifications of housing; to define "manufactured home park" to provide exceptions from the definition; to the sales and use taxes applicable to manufactured homes; to require that all manufactured and mobile homes pay ether a real property tax or a manufactured home tax; to specify that homes taxed as real property must be attached to a permanent foundation on land owned by the owner of the home; to permit manufactured and mobile homes located in the state prior to January 1, 1998, to continue to pay manufactured home taxes pursuant to the existing depreciation schedule; to base the manufactured home tax for homes locating in the state or changing ownership on or after January 1, 1998, on the assessed value of the home and calculated in a manner similar to real property; to establish procedures for surrender of the certificate of title when a home is to be taxed as real property; to specify conditions under which trailers and park trailers are taxed as manufactured and mobile homes; to define homestead to include specified manufactured and mobile homes and make changes in the homestead law to treat those homes as real property under that law; to clarify that state and local building codes do not govern manufactured homes but that all manufactured homes must be built pursuant to federal standards and carry a permanent tag to indicate compliance; to deem that manufactured homes built to federal standards meet Ohio and local energy standards for one, two, and three family homes; to require that manufactured homes that meet specified appearance criteria and are permanently duty of park operators and to extend that duty to all types of housing in a manufactured home park; to require a moving permit be obtained prior to moving a manufactured or mobile home on a public roadway and establish violations for not obtaining a permit; to expand local control of manufactured and mobile homes by requiring the clerk of court to notify owners that the home must be registered with the auditor, to require a certificate of title when a manufactured addition is made to a manufactured home, and to require that certificates of title be kept for thirty years instead of five years; and to change the motor vehicle law to reflect that manufactured homes are not motor vehicles. Revises the procedure by which property owners may detach their property from a municipal corporation and establishes procedures by which a township may petition for detachment of territory from a municipal corporation. SB 166 SCHOOL DISTRICT ANNEXATION (LATELL)To amend sections 303.12, 519.12, 709.02, 709.03, 709.031, 709.032, 709.033, and 713.12, to enact new section 709.07, and to repeal section 709.07 of the Revised Code to include the possible adverse effects of a proposed annexation upon school districts as a consideration in the granting or denying of municipal annexation petitions, to change the process for appealing municipal annexation decisions, and to require notification of school districts of proposed amendments to zoning codes and proposed municipal annexations. SB 180 UTILITY TAXES (BLESSING) Am., En. & Rep. 113, 319, 719, 4905, 4909, 4931,4933, 4939, 5703, 5705, 5711, 5717, 5727, 5733, 5739, 5741, 5745 & 5747. Levies a 7% excise tax on purchases of electric service; levies a 6% sales and use tax on sales of natural gas or telecommunications service; requires that electric companies, rural electric companies, natural gas companies and telephone, companies pay the corporation franchise tax rather than the public utility excise tax; requires electric companies and telephone companies to pay municipal income taxes; reduces tax assessment rates on the tangible personal property of electric companies and natural gas companies and requires a reduction in customers' rates. The bill has been assigned to Senate Ways & Means Committee. SB 184 OPEN RECORDS (OELSLAGER) Amend section 149.43 of the Revised Code to grant members of the public the option of choosing the medium in which they will receive copies of public records, to require a public office to transmit copies of a public record through the United States mail if so requested, and to specify that orders and awards made under the Public Records Law are remedial and not punitive. The bill has passed out of the Senate 32-0 and has been referred to the House State Government Committee. SB 186 PUBLIC WORKS DISTRICTS (LATTA) To amend section 164.04 of the Revised Code to require the appointing authorities that appoint members of district public works integrating committees to appoint alternates for those members to act in their absence. The bill has been assigned to the House Transportation & Public Safety Committee. SB 201 WATER & SEWER DISTRICTS (OELSLAGER) To amend sections 6119.02, 6119.04, 6119.05, 6119.06, 6119.10, 6119.28, and 6119.41 and to enact sections 6119.061 and 6119.071 of the Revised Code to provide for the filing of a petition of remonstrance to preclude the establishment of a regional water and sewer district, to provide for the removal of members from the board of trustees of a district, to require a board to conduct a feasibility study prior to proceeding with certain projects or improvements, and to prohibit a board from awarding a contract to the entity that conducts the feasibility study for the same project. The bill has passed the Senate and has yet to be assigned to a House Committee. SB 204 PROPERTY SALES (LATTA) To amend sections 2329.13, 2329.14, 2329.26, and 2329.27 of the Revised Code to require a specified written notice be given to certain parties to the underlying action prior to an execution sale of real or personal property and to specify consequences of an execution sale that occurs after that notice and public notice by newspaper publication has been given. The bill has been assigned to the Senate Judiciary Committee. SB 210 PORT AUTHORITY (OELSLAGER) Am., En., & Rep. 9, 109, 165, 307, 349, 2901, 2921, 2935 & 4582. Comprehensively revises the power and duties of port authorities, enhances the ability of port authorities and other political subdivisions to cooperate in the accomplishment of mutual objectives, establishes more consistency between the statutes governing port authorities established on or before July 9, 1982 and those established after that date, makes other changes in the laws governing and declares an emergency. The bill passed the Senate and has been assigned to the House Transportation & Public Safety Committee. SB 221 TOBACCO (DRAKE) Am. & En. 2927 & 5743. Makes the offenses of illegal distribution of cigarettes or other tobacco products applicable to persons under twenty-one years of age, increases the penalty for that offense and requires the revocation of the wholesale or retail license of a person who is convicted of the offense three or more times within a ten year period. The bill has been referred to the Senate Health Committee. SB 222 LAW ENFORCEMENT (GARDNER) To amend sections 1533.67, 1721.19, 2331.11, 2331.13, 3767.12, 3773.99, 4953.11, 4973.23, 4973.25, and 5923.27, to enact section 2923.162, and to repeal sections 1741.01, 1741-02, 1741.03, 1741.04, 1741.05, 1741.06, 1741.07, 1741.08, 1741.09,1741.10, 1741.11 1741.12, 1741.13, 1741.14, 1741.99, 2331.12, 3773.05, 3773..07, 3773.21, and 3773.211 of the Revised Code to eliminate certain exemptions from arrest, to revise the law enforcement powers that are granted to certain persons who are not traditional law enforcement officers, to eliminate, consolidate, or modify certain archaic law enforcement related provisions and offenses, and to repeal the law dealing with bridge companies. The bill has been assigned to the Senate Judiciary Committee. SB 223 CONSERVATION EASEMENTS (DRAKE) To amend sections 133.07, 317.08, 317.32, 5301.67 to 5301.69, 5705.19 and 5739.026 and to enact sections 133.60, 133.61, 901.21, 901.22, 5301.691, and 5301.692 of the Revised Code to clarify the agricultural land uses that may be the subject of conservation easements; to authorize only the Director of Agriculture, local governments, and charitable organizations to acquire conservation easements in order to preserve the agricultural use of land; to permit counties to levy or increase the rate of a sales or use tax to acquire conservation easements and retire bonds issued for their purchase; to permit local governments to levy a tax outside the ten-mill limitation to acquire, supervise, and enforce conservation easements and to issue general obligation bonds to finance them; and to authorize the extinguishment of those conservation easements under specified circumstances. The bill has been assigned to the House Ways & Means Committee. SB 229 ODOT/LAND PURCHASES (OELSLAGER) To amend sections 124.34, 4117.01, 5501.31, 5513.02, 5515.02, 5521.01, and 5525.19, to enact section 5501.20, and to repeal section 5501.19 of the Revised Code to make changes in certain laws governing the Department of Transportation in the areas of appropriation of property for political subdivisions for transportation purposes and the purchase of certain supplies by the Department, to create a pilot program establishing the career professional service within the classified civil service of the Department of Transportation and authorizing the Department to appoint persons to positions within the career professional service, and to eliminate the right of certain unclassified employees of the Department to return to classified positions they previously held. The bill has been assigned to the Senate Highways & Transportation Committee. SB 237 ELECTRIC DEREGULATION (B. Johnson) Am., En. & Rep, 113, 718, 1551, 3317, 4905, 4906, 4909, 4911, 4913, 4928, 4933, 4935, 5703., 5705, 5727 and 5733. Provides for competition in retail electric service, including provisions regarding market structure, consumer protection, retail marketing areas, and transition revenues: levies a kilowatt-hour excise tax on electric distribution companies; revises taxes for electric companies and rural electric companies, and reduces tax assessment rates on the tangible personal property of electric companies and rural electric companies, except for transmission and distribution property. The bill has been assigned to the Senate Ways & Means Committee. SB 238 REINVESTMENT AREAS (Horn) Amends 3735. Prohibits a municipal corporation or county from entering into a community reinvestment areas (CRA) tax-exemption agreement, with any person that has business operations elsewhere in Ohio if part or all of those operations will be relocated to the CRA, unless the Director of Development determines that specific conditions are met and issues a relocation waiver, and permits the Director to issue such a waiver to enable a person that is a party to a CRA agreement and discontinues operations prior to the expiration of that agreement to enter into another agreement providing CRA or enterprise zone incentives if it meets specified conditions. The bill has been assigned to the Senate Economic Development, Technology & Aerospace Committee. SB 248 VILLAGE INCORPORATION (Gaeth) Amends 707. Allows territory to incorporate as a village with a population of as few as 25 persons if the territory meets specified conditions. The bill has been referred to the Senate State & Local Government & Veterans' Affairs Committee. SB 250 SOLID WASTE MANAGEMENT (Horn) Enacts Section 3734 of the Ohio Revised Code. Requires specified political subdivisions to determine annually the full cost of solid waste management services provided by the political subdivisions. The bill has been referred to the Senate State & Local Government & Veterans' Affairs Committee.

The bill has been referred to the House Criminal Justice Committee. HB 8 EMISSIONS TESTING (GRENDELL) Am , En. & Rep. 3704, 3706, 4503 & 5739. Repeals the motor vehicle inspection and maintenance program and requires the Director of Environmental Protection Agency to negotiate alternatives to the program. The bill has been assigned to the House Energy & Environment Committee. HB 15 EMISSIONS TESTING (MOTTL) Am & Rep. 3704, 3706, 4503 & 5739. Repeals the motor vehicle inspection and maintenance program. The bill has been assigned to the House Energy & Environment Committee. HB 22 SUBDIVISION PLATS (WISE) Am 711. Eliminates the requirement that subdivision plats in certain unincorporated territory be approved by a city planning commission or by a village planning commission, platting commissioner or legislative authority before being recorded and requires plat approval instead by a county or regional planning commission and permits platting rules to require proof of compliance with all applicable township zoning resolutions. The bill passed both Houses of the General Assembly and has been signed by the Governor. The bill became effective 10/21/97. HB 23 STATES' RIGHTS (WISE) Am 103 & 109. Requires the review of each bill introduced in either house of the General Assembly to determine whether compliance with a mandate imposed by federal law is among the bill's purposes and, if so, whether the federal mandate violates Ohio's rights under the Tenth Amendment to the U.S. Constitution and establishes a procedure for challenging the constitutionality of federal laws that impose mandates on the state. The bill has been assigned to the House State Government Committee. HB 26 SANITARY DISTRICTS (LUCAS) Am & En. 121, 145 & 6115. Alters the composition and method of appointment of the members of the boards of directors of certain existing sanitary districts organized to provide a water supply for domestic, municipal and public use and limits the compensation paid and benefits provided to board members. The bill has been signed by the Governor and will become effective May 6, 1998. HB 29 E-CHECK (REID) Am. & En. 3704. Requires the Director of Environmental Protection Agency to take specified actions to discontinue the motor vehicle inspection and maintenance program by July 1, 1998, while assisting the state to comply with the Federal Clean Air Act Amendments; extends the exemptions for new vehicles under the program; revises the waiver limits for motor vehicles needing repairs under the program. Levies an excise tax on purchases of certain telecommunications services; establishes a procedure under which property tax assessment rates on telephone company tangible personal property are raised or lowered depending on whether the company elects to subject purchases of its local telephone services to the new excise tax; subjects telephone companies and other providers of local telephone service to the corporate franchise tax; lowers the rate of the public utility excise tax for telephone companies and imposes that tax at the new lower rate on other providers of new telephone service; provides that the sales tax does not apply to long distance and cellular telephone telecommunications service excise tax revenue designed in part to offset local government revenue losses caused by the other changes. Permits public employers to become self-insuring employers for purposes of the Workers Compensation Law; permits certain organizations with a membership consisting of public employers to qualify for self-insuring status; requires the Administrator of Workers' Compensation to adopt rules regarding claims administrators; decreases the number of votes necessary for the Self-Insuring Employers Evaluation Board to revoke an employer's self-insuring status, and requires the Administrator to provide for the payment of claims of a defaulting self-insuring employer within 30 days after the default. Makes various changes in the structure, payment and determination of benefits; reduces the number of weeks an employee can receive nonworking wage loss; permits an employer to have an employee exempted from the Workers' Compensation Law for religious reasons; changes the duration of the continuing jurisdiction of the Industrial Commission to three years; requires hearing officers to report suspected fraudulent activity; limits recovery for aggravation of a preexisting condition; changes the definition of occupational disease; permits certain nonattorneys to represent parties in hearings before the Industrial Commission; creates the presumption concerning alcohol or a controlled substance as the cause of an employee's injury; exempted buildings and land used for agricultural production from safety rules that apply to workshops and factories; provides criminal penalties for employers who intentional misclassify their employees for workers' compensation purposes; prohibits kickbacks from health care providers under the Workers' Compensation Law; prohibits health care providers from receiving payments for false claims under the Workers Compensation law; provides that records kept by the Division of Safety and Hygiene are confidential; specifics that records produced by an attorney in connection with a workers' compensation claim are the property of the claimant; and makes other changes in the Workers' Compensation Law. HB 329 BRADY ACT (YOUNG) To enact sections 2921.26 and 2921.431 of the Revised Code to prohibit any public official to charge a fee or tax under Public Law 103-159, the Brady Act, for any action taken to implement that Act, and to prohibit persons in possession of any information about any individual obtained under that Act to communicate it to any person not entitled to receive it or fail to destroy such information as required by this law. HB 345 EMINENT DOMAIN (TAYLOR) To amend sections 163.07, 163.08, 163.14, 163.15, 13 163.16, 163.17, 163.18, 163.19, 163.21, 163.59, 14 and 163.62 of the Revised Code to require agencies to pay in just amounts determined by a court the attorney's fees, witness fees, and other actual expenses that a property owner incurs in eminent domain proceedings if the compensation and damages that the jury assesses for the affected property exceed the agency ''highest offer" for the property by 10 per cent or more. HB 371 DELINQUENT TAXES (HODGES) Permits county treasurers of counties having populations of at least 200,000 to collect delinquent real property taxes by selling certificates entitling the bearers to liens against the property in the amount of the delinquency. HB 372 EMERGENCY TELEPHONE (GRENDELL) Authorizes county commissioners to propose a county charge billed monthly through telephone bills to pay for one or more public safety answering points of a countywide 9-1-1 emergency telephone system and requires a county that imposes such a charge to reimburse participating subdivisions for the training of public safety answering point telecommunicators. Gives 30% of the moneys and of the sale proceeds of property seized on the premises of a metropolitan housing authority and forfeited under the Felony Drug Abuse Offense Forfeiture Law to the metropolitan housing authority to use for community preventive education programs. Increases the rate of the states tax on motor vehicle fuel if and only upon the scheduled expiration of the temporary federal fuel tax rate increase on Sept. 30, 1999, with the result that the net combined federal and state tax rate will decrease and revenue previously received by the federal government will be received by the state ; and repeals the increase in the state's tax rate in two stages after six years. HB 452 HOUSING TRUST FUND (JOHNSON) To amend sections 175.21, 175.220, 175.25, 176.07, 317.32, 1309.40 1309.42, 1563.42, 1702.59, 2505.13, 4141.23, 4509.60, 5111.021, 5310.15, 5719.07, 5727.56, 5733.18, 5733.22, 6101.09, 6115.09 and to enact sections 175.251, 317.36, and 319.63 of the Revised Code to require that county recorders collect housing trust fund fees for the benefit of the Low- and Moderate-Income Housing Trust Fund in the state treasury; to establish housing trust fund fees as an amount equal to fifty per cent of the fees that county recorders charge for specified services; to permit counties to retain one per cent off housing trust fund fees for administrative purposes and to require that counties pay the remainder to the Treasurer of State; change the name of the "Housing Trust Fund Advisory Committee" to the "Housing Trust Fund 44 Oversight Committee" and expand its membership by eight members; to charge the Committee with overseeing the distribution of trust fund moneys; to require that the Department of Development adopt rules governing the mechanisms and criteria to be used in distributing trust fund moneys and to require that no trust fund moneys be distributed without the Oversight Committee's recommendation; to specify that the rules include requirements for the long-term maintenance of housing, that distributions not conflict with local housing plans, and that trust fund moneys not be used to replace existing project-based Section 8 rent subsidies; and to increase trust fund allocations for rural areas from thirty-five to forty per cent. HB 563 ELECTRIC POWER SUPPLIES (TERWILLEGER) To enact sections 4928.01 to 4928.04 of the Revised Code to allow any customer within a community reinvestment area, enterprise zone, joint economic development district, or joint economic development zone, and to allow any political subdivision, to purchase electricity and related electric service from any supplier as of the act's effective date; to authorize a governmental entity creating such an area, district, or zone to be a retail supplier to such a customer; to authorize such a governmental, retail supplier to be a retail supplier also to an electric load center of any political subdivision within its jurisdictional boundaries; and to terminate the provisions of this act on January 1, 2003, by repealing sections 4928.01, 4928.02, 4928.03, and 4928.04 of the Revised Code on that date.
