LEAGUE ASKING FOR IMPORTANT TAX INFORMATION

A couple of weeks ago, the League sent a brief questionnaire to all municipal tax administrators asking how an important piece of legislation (HB 803) would affect their municipality's tax revenues if passed. The bill would make several changes in the municipal income tax. Those changes have been advocated by the Ohio Society of CPA's for many years. While the League has many views on the various provisions of the bill, we asked tax administrators for information on three specific issues.

The first bit of information we wanted was an assessment of the impact of one provision of HB 803 which would require municipalities to give 100% credit on the income tax for all residents who worked outside of their home municipality. This, of course, was information we needed only from those communities which currently have a reduced credit.

The second part of the survey asked how municipalities currently program the software used for administering their income tax. Many changes proposed in HB 803 would require changes in that programming and we wanted to know whether such programming was done in-house or through an outside contract. We also asked if your city or village has mandatory filing. This is information we wanted from all income tax municipalities.

While the response to our survey has been good, we could use information from more communities, especially from those communities with a reduced credit. Any gentle inquiries you could make to your income tax administrator about the return of our survey would be very helpful.

ODOT RESOLUTIONS

We have had a number of requests for sample resolutions protesting ODOT's policy that says, when it comes to repaving costs the state and federal highway system ends at the city line. We have reprinted what we think is a very good resolution on the back of this bulletin. We would encourage all cities with state and federal routes within their borders to pass a similar resolution and send copies to your local media, local legislators, Governor Voinovich (77 S. High St, Columbus 43215), ODOT Director Jerry Wray (25 S. Front St., Columbus 43215), and the candidates for governor, Robert Taft (16 E. Broad St., Suite 1214, Columbus 43215) and Lee Fisher (37 N. Third St., Columbus 43215).

A RESOLUTION OPPOSING THE CHANGE IN POLICY BY THE OHIO DEPARTMENT OF TRANSPORTATION TO NO LONGER MAINTAIN STATE ROUTES WITH MUNICIPALITIES.

WHEREAS, the Ohio Department of Transportation has determined to exercise its rights under § 5501.31 R.C. to cease participation in local road construction; and

WHEREAS, failure to participate will overburden a community such as Streetsboro whose principal arterials are state highways; and

WHEREAS, Streetsboro receives disproportionate traffic because of Sea World, Geauga Lake and the recent Ohio Turnpike rate increase.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Streetsboro, Portage County, Ohio, a majority of the members elected or appointed thereto concurring:

SECTION 1: The City of Streetsboro contains approximately 14.42 miles of state highway and is serviced by a turnpike exit, exit 13.

SECTION 2: By virtue thereof, Streetsboro is a routing site for traffic going to Sea World of Ohio and Geauga Lake Park and is a primary attractor of visitors to the State of Ohio. In that respect, it is similar to Cedar Point.

SECTION 3: Road improvements to state highways from mid 1989 until late 1995 totalled 2.1 million dollars. This cycle of repair is currently ready for reconstruction with the 2.10 mile project previously completed at a cost of $363,417.05 scheduled to cost between $600,000-700,000. It is anticipated tile remaining projects, when scheduled, will also double in costs.

SECTION 4: Streetsboro's available operating budget for road repairs and improvements in 1998 is approximately $300,000.

SECTION 5: It is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance, were adopted in an open meeting or meetings of this Council that all deliberations of this Council and any of its committees that resulted in such formal action, were in meetings open to the public, in full compliance with all legal requirements, including without limitation, those set forth in Section 121.22 of the Ohio Revised Code.

SECTION 6: That this Resolution shall take effect and be in full force from and after the earliest period allowed by law.
